Circumstantial evidence


Jane Vallez Mitchell of HLN's Issues today gave  an example of circumstantial evidence that i thought was very insightful and easy to understand although not exactly the definition of the words in my dictionary.

She said "you wake up in the morning and go outside to get the newspaper. It's been thrown on the grass which is wet and the paper is soaked through. The sky is dark and cloudy and the trees and all the plants are wet, the houses and cars all have water droplets all over them and theres puddles of water in the street. You didn't hear or see the rain but you know obviously it has rained during the night."

My dictionary which is old and grey says circumstantial means "incidental, not essential and not important" What???

It most definitely had been raining and i think even a dimwit can figure that out.

And so can a jury who heard all about Casey Anthonys lies and her mysterious actions on the day her daughter was last seen with her driving away. That along with the many experts who testified as well as the many incidences told of her life tells a tale of which there's no mistaking that she killed the child and covered her tail while the body decomposed.
The jury didn't need to have any cause of death specified as Caylee was a healthy 3 yr. old. It's proof enough that the kid was found dead, duct taped, triple bagged and thrown away like trash and then mama enjoyed her freedom for 31 days. There's just no excuse for coming back with not guilty.

Just like in the example from Jane all it takes is common sense to know what happened. Anthony is guilty as hell, there's just no other answer.

I did not follow all of the Casey Anthony trial, but I am very puzzled by the outcome given what I did read. I guess we will have to wait for the book.... and there will be a book!!! This woman will probably get a movie deal too! Who ever said "life was fair"?

Thanks for the comment Catz. Well,i don't think many would buy her book and Hollywood wants no part of her even tho i do think she'd love the attention where would she be able to be visible anywhere? There's tons of people who'd like to see her dead. The police's responsibility is to just get her safely to the airport and on a plane this Sunday and then she's on her own with no family or friends.....and then soon be back in Orlando to face off with the real Zenaida Fernandez-Gonzoles in her case. The jury has also had to hide away due to death threats and some have spoken up now saying they really thought she was guilty.
Somebody on that jury saw the beneficial possibilities of saying not guilty and managed to bullwinkle the rest who are in fear for their lives and their families. One has already turned down a 60,000 fee for an interview. Really can't see any of them profit from any of this and end up happy over it. This woman has left a horrible ongoing mess in her quake. She is recognised around the world and won't last long in the real world; at least not the kind of world she wants to live in. But maybe in a tiny village in Mongolia......

I just watched Greta Van Susteren's interview with the jury foreman. I really wished I hadn't watched... It really frustrated me. I can't help to think that maybe one juror possibly influenced the rest of them into such a poor verdict. He was saying the jury didn't find the cause for why Casey killed Caylee to be 'believable'. The prosecution doesn't even have to prove cause ! On another note I say this video for the first time today... She's Going Places-Shane Hines(Caylee's Song) Really sad...

Thanks for the song Anon, yes, i kwym even tho i don't know Greta; i get most of my info from the HLN shows,FB and google.
Maybe Casey didn't mean to kill Caylee. Maybe she had chloroformed her in the trunk a few times too many so she could party. Maybe she had the roll of duct tape from home handy in the trunk to apply to Caylee's mouth in case she woke and cried....couldn't get caught because of a passerby hearing cries coming from her car trunk. Finally one day maybe she found her dead, either od'ed or left in the hot trunk too long. Can't really call 911 at that point either because people wouldn't understand.Drove around a couple days and when the smell got too strong had to do something about it as gruesome as it was. It was her responsibility; she was the mother. She opened the trunk and saw the decomp flowing out of her mouth and nose so put more tape to stop the leakage. Maybe she was horrified but how can you tell anyone at this point. So drove home thinking to bury her, backed the car in and borrowed a shovel but the ground was too hard to dig a hole that size. Now what to do? Thinking, thinking. Call someone? No, she'd be the talk of the town and totally misunderstood and probably have to go to jail! Have to hide the body and so she did at the closest most familiar spot. She probably felt real bad doing it but the smell was so bad she had to. Probably appeased her motherly instincts by putting the heart sticker over the mouth area. Went home, put the tape away, showered got a complete change of clothes, dumped the tainted clothes and shoes in a dumpster and drove the car to the lot where she abandoned it and acted like it was just another ordinary day.

Yes I agree what you said is probably very close to what happened. I am no fan of Leonard Padilla, but I saw a compelling video posted on fox awhile back where he visited the spot where Caylee's body was discovered. I think he was with a woman who was an attorney or possibly a judge. I may have seen her before on HLN. They gave a timeline similar to the one you just described. I would post it but I can't find it anywhere. I agree you are correct about what may have happened. It may not have been 'intentional'. She was probably using choloform to subdue Caylee so she could go party. Maybe a lesser criminal charge would have had a different outcome in court... Its hard to say. I believe they said Caylee's fingerprints were not found in the trunk. I know very little about DNA or CSI... I am not sure how much effort it would have taken to wipe them clean. She may have been so sedated and restrained and wrapped in a blanket where she wasn't in a position to touch anything. Maybe you can't leave fingerprints on the carpet interior of a trunk and she would have had to reach a bit to touch the top... But I wonder why there were computer searches for neck breaking...

Anon,i like Leonard Padilla but didn't see the video you mentioned. He seems to be a hard working honest man and he's always had the best common sense theories and he knew KC well.I hate the way he gets treated on the HLN shows especially when Mark Ugliness is on. All he wants to do is belittle the man, flick his hat off and make stupid eating up valuable time instead of giving Len some time to tell what he knows.Dr. Drew is such a wimp and can't control the guy and having them both on at the same time is a huge waste.
I think you're right about the trunk having no fingerprints. KC might have knocked her out before putting her in there. Poor little girl must have been terrified there in the dark and didn't move.But who knows about chloroform? Those experts who testified could have been asked more questions. Maybe there was enough in there to keep her asleep until the trunk was opened and the fresh air blew in.Or maybe KC opened it and took her out and into the car right away to wake up. She must have worried that Caylee might be able to say something or show fear and not want to go near the car again and then CC or GG might get suspicious.
Speaking of which, do you think it weird George and Cindy had Caylee call them GG and CC? So disfunctional to not be grandpa and grandma like everyone else.

I think she started thinking of how to do the kid in several months prior when she started filming those silent videos. In the silent breakfast video she actually went down video'ing under the table, maybe hoping Caylee would lean over far enough to tip the highchair. Those vids are so sad and to me they show a form of child abuse as she wouldn't even say a word to Caylee and that must have been very frustrating for Caylee.But maybe if she tipped the highchair over she might break her neck or die from the injuries and all caught on video. So as she thought of different things like how people die from broken necks she googled how it could be done accidently like maybe in a fall from a playground swing because the highchair was designed to not fall over. How about jumping on the bed and fall off. Or dancing wildly to loud music and fall and hit her head or break her neck. Ditto ruptured spleen....is that something that could happen if a kid fell from a swing or whatever. She needed to know where the spleen is located and exactly how to make it look like a freak accident; if was even possible and then set the kid up for the scene. And so on. Then the kid goes and dies from something she shouldn't have and KC knew that couldn't be revealed without repercussions on her.The whole thing was like a tragedy of errors.
Now i'm getting carried away again i think. Just always hoping to find answers or think of a reasonable method to her madness.But i seriously doubt we'll ever find out but who knows. We had a child killer in Canada years ago who kept mum until after he was set free. Then went and told a newspaper exactly how he did it.By then he'd already served the time and couldn't be tried for the same crime again. I think he died of cancer or something soon after.

There are so many odd things in this case, calling her grandparents GG and CC doesn't seem so bad :) Many children have nicknames for their family. Maybe she started this when she was too tiny to pronounce grandma and grandpa and it stuck...

I don't think I believe any of the terrible accusations about sexual abuse that were made in court about her father. That isn't to say they aren't absolutely true but there was no real indication of it, especially since Casey, a grown woman, continued to live with them and allowed her baby daughter to live there. It doesn't seem she made any real effort to remove herself from her home life, which indicates to me she felt secure there. The one thing they were guilty of was enabling Casey's behaviors...

Now possibly Casey will struggle with the fate she caused her daughter and the possible lies she told about her family..

I am not familiar with the criminal justice system in Canada. I hope that man served more time than Casey did. I wonder if this would have gone different in Canada... and if Canada has rules on people on trial profiting from their experience ...

I am usually the type of person who wants to see less laws not more... but then something like this happens as a reminder that not everyone shares basic morals... mainly not harming your children or any children or any innocent person ...

I didn't mean to suggest that the use of names GG +CC were a big deal, it's just another one of the many weird things in this terribly disfunctional family who probably felt they were too young to be called grandpa and grandma and yet wouldn't let KC give her up for adoption.They loved the fun and cute part of having a baby around but they wern't very responsible people themselves.I agree definitely there was probably no sexual abuse going on there; it just more of KC lies.
It seems to me they were not only enablers but actually encouraged lying and Cindy esp. should have been charged with something; even a slap on the wrist so all could acknowledge what she did would have been better than getting off scott free. And i had thought Judge Perry was such a good judge throughout but then he let this go?! He was so harsh on that kid who flipped a finger so not very consistant with fairness. He must have been drinking the KC koolaid!
I don't think Canada has any laws or rules re people profiting in any way. The murderer i mentioned was many yrs ago and i think he did his time, whatever it was and then bragged the story to a newspaper for free knowing he couldn't be charged again.
I also agree on the need for less laws instead of more. More means the system will be over burdened with unnecessary calls and the important or real calls could be left in the dust.Another law would have worked in this case to put KC away for a while longer but against in another case so what can you do but just hope something like this dosn't happen again.

I followed every second.

The problem being, we've been told to be acceptable of all things: to be open minded, and to follow the law to the letter.

Open minds have caused too many brains to fall out.

Accepting all things has produced people with no boundaries.

The letter of the law is to protect the guilty and the jury mistook reasonable doubt as UNREASONABLE doubt without knowing there's a difference.

All I know is if I had been on the jury, there'd be no death threats against me. I'd be considered the only juror who HAD a brain, and I'd have already appeared on Good Morning America.

More evidence that common sense is NOT common at all.
